Terms of Service

1. Acceptance of Terms

By accessing Celtic Golf Centre's website, making a booking, or using our facilities and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Bookings and Payment

All bay bookings are subject to availability and confirmation. By making a booking, you agree to:

• Provide accurate and complete contact and payment information
• Arrive on time for your scheduled session (your session time begins at the booked time regardless of late arrival)
• Pay all applicable fees, including any additional charges incurred during your visit
• Present valid government-issued ID if requested

Prices are subject to change without notice. Applicable taxes will be added to all purchases.

3. Cancellation and No-Show Policy

We understand plans change. Our cancellation policy is as follows:

• 2+ hours notice: Free cancellation or rescheduling
• Less than 2 hours notice: Cancellation fee may apply
• No-show: Charged for 1 hour of sim time ($50 + tax)

To cancel or reschedule, please contact your booking location directly or use the cancellation link in your confirmation email. We reserve the right to cancel bookings due to unforeseen circumstances, in which case a full refund will be provided.

4. Assumption of Risk

YOU ACKNOWLEDGE AND AGREE THAT:

• Golf and indoor golf simulation involve inherent risks of physical injury, including but not limited to: muscle strains, back injuries, being struck by a golf club or ball, slips, trips, and falls
• You are voluntarily participating in these activities with full knowledge of the risks involved
• You are physically capable of participating in golf activities and have no medical conditions that would prevent safe participation
• You will immediately notify staff of any injury, equipment malfunction, or unsafe condition
• You assume full responsibility for any injury, loss, or damage that may result from your participation

5. Liability Waiver and Release

To the fullest extent permitted by law, you hereby release, waive, and forever discharge Celtic Golf Centre, its owners, officers, employees, agents, and affiliates from any and all claims, demands, damages, costs, expenses, and causes of action arising out of or related to:

• Personal injury, death, or property damage occurring on our premises or resulting from use of our facilities and equipment
• The actions or negligence of other guests or third parties
• Loss or theft of personal property
• Any injury resulting from alcohol consumption

This waiver does not apply to claims arising from our gross negligence or willful misconduct.

6. Indemnification

You agree to indemnify, defend, and hold harmless Celtic Golf Centre and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your use of our facilities or services; (b) your violation of these Terms; (c) your violation of any rights of another person or entity; or (d) any injury or damage caused by you to another person while on our premises.

7. Facility Rules and Conduct

While using our facilities, you agree to:

• Follow all posted rules, signs, and verbal instructions from staff
• Use all equipment properly and only for its intended purpose
• Wear appropriate footwear (no bare feet, flip-flops, or high heels in bays)
• Conduct practice swings only within designated areas
• Minors are welcome; we recommend a parent or guardian on-site for younger guests.
• Treat staff and other guests with respect
• Refrain from disruptive, dangerous, or inappropriate behavior
• Not bring outside food or beverages (excluding baby food/formula)
• Report any equipment damage, malfunction, or safety concerns immediately

We reserve the right to refuse service or remove any person from the premises for violation of these rules or for any behavior we deem inappropriate, without refund.

8. Equipment and Property Damage

Our TrackMan simulators, screens, projectors, and other equipment represent a significant investment. You agree that:

• You are responsible for any damage to our equipment, facilities, or property caused by you or members of your party through misuse, negligence, or intentional acts
• Damage costs will be charged to the payment method on file
• You will not attempt to modify, repair, or tamper with any equipment
• You will use only approved golf balls provided or approved by us

Please bring your own clubs. Sharing between guests is welcome. Celtic Golf Centre Kingston is not responsible for loss, theft, or damage to personal equipment or belongings left at our facility.

9. Alcohol Policy

Celtic Golf Centre is a licensed establishment under the Liquor Licence and Control Act (Ontario). By consuming alcohol on our premises, you acknowledge and agree that:

• You must be 19 years of age or older to purchase or consume alcohol
• Valid government-issued photo ID is required for alcohol purchases
• We reserve the right to refuse alcohol service to anyone at our discretion
• Intoxicated persons may be asked to leave without refund
• You are solely responsible for your alcohol consumption and any resulting impairment
• We are not liable for any injury, accident, or incident resulting from your alcohol consumption
• You will not operate a vehicle while impaired and will arrange safe transportation

10. Age Requirements and Minors

Guests of all ages are welcome at Celtic Golf Centre. We recommend a parent or guardian on-site for younger guests. Minors may attend unaccompanied with a parent or guardian emergency contact on file, and the parent or guardian accepts responsibility for the minor's actions and safety. The parent or guardian agrees to these Terms on behalf of any minors in their party.

11. Photo and Video Consent

By entering Celtic Golf Centre, you consent to being photographed or recorded for security purposes. Additionally, you grant permission for any photos or videos taken by staff to be used for promotional and marketing purposes, including on our website and social media, without compensation. If you do not wish to be photographed for marketing purposes, please inform staff upon arrival.

12. Gift Cards and Promotional Credits

Gift cards and promotional credits are non-refundable and cannot be exchanged for cash. Lost or stolen gift cards cannot be replaced. Gift cards do not expire. Promotional offers cannot be combined unless explicitly stated.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CELTIC GOLF CENTRE KINGSTON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Ontario, and you hereby consent to such jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Celtic Golf Centre regarding your use of our facilities and services, and supersede any prior agreements or understandings.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
